The Right To Know Cell Phone Labeling Ordinance


May 12, 2015 Berkeley Adopted the Cell Phone "Right to Know" Ordinance on a Unanimous Vote.


When you buy a phone you will get a notice stating: 

"To assure safety, the Federal Government requires that cell phones meet radio frequency (RF) exposure guidelines. If you carry or use your phone in a pants or shirt pocket or tucked into a bra when the phone is ON and connected to a wireless network, you may exceed the federal guidelines for exposure to RF radiation. This potential risk is greater for children. Refer to the instructions in your phone or user manual for information about how to use your phone safely."

Berkeley is the first city in the nation to pass a cell phone radiation ordinance since San Francisco disbanded its ordinance after a two-year court battle with the CTIA.

Harvard Law Professor Lawrence Lessig helped draft the ordinance and presented it to the Council on behalf of city staff.

The only opposition to the ordinance came from the CTIA--The Wireless Association. The CTIA claims that consumers would be scared if they were directed to read the information that the FCC requires they provide to consumers.

12/2014: Wireless Router Labeling: The Suffolk County New York Legislature passed legislation to require all county buildings to post notices that wireless routers are in use such as, "Notice: Wireless technology in use."


The resolution, sponsored by Legis. William Spencer (a physician), warns that every wireless device emits radio frequency radiation or microwave radiation. It notes that studies "that have looked at the effects of low-level RFR radiation on human cells and DNA have been inconclusive."










11/24/2014: The Greenbelt Maryland City Council voted unanimously to:

  • Alert citizens about health risks and the fine print warnings buried in the fine print of wireless devices by handing out brochures at health fairs.
  •  To send the FCC Chairman a letter urging the adoption of “radiation standards that will protect human health and safety.”
  • To voice full Council opposition the County's controversial plan to place cell towers on 73 county schools.

2012: Jackson Hole Wyoming issued a  Proclamation of Cell Phone Awareness which cites concern over the long term health effects as well as the increased risk that the radiation poses to children.


"WHEREAS, these longer term risks may be greater for children than adults because their skulls are thinner and their brains and bodies are smaller and faster growing;"










2012 The Pembroke Pines Commission passed Resolution 3362  expressing the City's "Urgent Concerns" about Wireless Radiation and Health. The Resolution  encourages citizens to read their manuals and presents information on how to reduce exposure by using a headset or speakerphone.


Attorney Jimmy Gonzalez petitioned the Commission for the action after he developed brain cancer from heavy cell use. Please watch the video of his powerful testimony to the left.

The San Francisco Cell Phone Right to Know Ordinance

(AKA How Industry Wants to Squash our Right to Know)


Passed: This 2011 Ordinance was passed by the City of San Francisco requiring cell phone retailers to distribute an educational sheet created by the San Francisco Department of Environment that explains radiofrequency emissions from cell phones and details how consumers can minimize their exposure.


A three year court battle:The CTIA sued the cityand settled with the City to block implementation of  the Ordinance  in exchange for a waiver of attorneys' fees. The City Cell Phone Radiation Webpage remains online.

2015 Two Wireless Right To Know Bills Introduced

​HB 3350

  • Directs the Department of Education to prepare statement that discloses potential health risks of wireless technology.

  • Requires public and private schools to distribute statement to employees and parents of students.
  • Declares an emergency effective July 1, 2015.

  • Cell phones must have a visible written label that advises consumers of possible risks and steps that consumers can take to reduce the risk of radio-frequency radiation exposure from cellular telephone use.

Wireless Information Act Almost Passed!

October is Cell Phone Radiation Awareness Month/Portland



2014: The Maine LD 1013 "The Wireless Information Act" passed the State Senate and House in 2014 but then failed to pass the second vote because of Industry pressure.  

  • The Bill required manufacturer's information on radio-frequency exposure be visible on the outside of the cell phone's product packaging.

State Bill To Warn About Possible Cancer Causing Radiation


2014: D-Sen. Josh Green of Kona, Ka‘u introduced the Senate Bill titled SB 2571, a measure calling for cell phones sold in Hawaii to come with a prominent health warning — similar to what smokers see on the sides of cigarette packages to warn them of danger.

Introduced Cell Phone Labeling Bill in 2011


SB 932: State Sen. Mark Leno's (D-San Francisco) bill would have required retailers to include notices on product packaging informing consumers that cell phones emit radio frequency energy.


"There's ever-mounting evidence of a likely relationship between long-term cell phone use and health risks when you put the phone next to your brain," Leno said. "Even cell phone user manuals suggest that you don't keep your phone on or next to your ear."


Notice proposed for the phone’s exterior packaging:
“This device emits radiofrequency energy. Consult the user’s manual for additional information on safe use”

State Bill to Research Human Health Effects Introduced


Representative  Brian Egolf introduced a Bill requesting a study of health effects:


HM 32 was entitled: A MEMORIAL REQUESTING THE DEPARTMENT OF HEALTH AND THE DEPARTMENT OF ENVIRONMENT TO STUDY AVAILABLE LITERATURE AND REPORTS ON THE EFFECTS OF CELL PHONE RADIATION ON HUMAN HEALTH.


"WHEREAS, studies have shown that the radiation emitted
from cell phone towers is, even at low levels, dangerous to
human health"

Cell Phone Labeling Bill Introduced in 2011


The Children’s Wireless Protection Act-House Bill 1408- was introduced in 2011

"The purpose of this act is to inform all citizens aboutpossible health dangers that have been linked to microwave radiation that is emitted by cellular telephones and the steps that can be taken to mitigate those dangers, especially as they relate to children and pregnant women."

Warning Labels on Cell Phones Bill Introduced


In 2011 Chip Shields (D-Portland) introduced SB 679 that would require warning labels for all new cell phones and cell phone packaging sold in Oregon.

WHEREAS, Electromagnetic Sensitivity is recognized by the Americans with Disabilities Act, the US Access Board and numerous commissions;"
